What is the Future of the Death Penalty?
The Supreme Court decided in a 6-2 ruling that Duane Buck, an inmate on death row, should get a new sentencing hearing on Tuesday. Buck was on trial for murder in Texas, during which his defense team had a witness testify that Buck is likely to be more dangerous in the future because he is black. Chief Justice John Roberts wrote in the majority opinion that “Buck may have been sentenced to death in part because of his race… that is a disturbing departure from a basic premise of our criminal justice system: Our law punishes people for what they do, not who they are.” As the second death penalty case the Court has taken this term, it looks like the Supreme Court might be taking a look at the constitutionality of the death penalty, something supported by the notorious RBG.
