Supreme Court Will Decide on Transgender Rights

The Supreme Court has stated that they will decide on a case involving Gavin Grimm, a trans boy who filed a lawsuit against his school board in Virginia so he could use the boy’s bathroom at school. This could decide more than just Grimm’s bathroom use. It could set national precedent and determine whether Title IX, the federal law that bans discrimination on the basis of sex, also applies to gender identity, which is how the Obama administration interpreted it. The Supreme Court Justices hope that Justice Scalia’s spot will be filled by the time they hear this case. If it isn’t, and there is a 4-4 split, the previous decision on the case will remain, that Mr. Grimm should be allowed to use the boy’s restroom, but there will be no national precedent set.
